- This contract covers the purchase of SAS Institute software, maintenance, and services from Executive Information Systems, LLC (EIS).
The Contract period listed in the Contract is for one(1) year or until the expiration of EIS' GSA contract (whichever is greater). The GSA contract expires on December 21, 2014.
Pricing for these items is established at the rates listed in EISí GSA schedule price list (Contract #GS-35F-0170K) (Contract Price List) which is in effect at the time of purchase. Note the web site address may change, but in October 2011, it is

This Contract also includes terms and conditions and hourly rates for professional and consulting services in order to simplify any future services negotiations. However, the State has no procurement authority to purchase the professional or consulting services using this Contract.
State Agencies are reminded that the IT Services Sourcing (VMS) Contract is a mandatory Contract. Therefore requests for SAS consulting and professional services must be routed through the VMS before this Contract can be used. The VMS has provided contractors with SAS experience in the past. (see below for more details)

This Contract has been issued to EIS because they are the only Contractor that SAS allows to sell SAS software at GSA pricing.
You should always check with SAS and EIS to make sure that the EIS pricing is the lowest when purchasing new software licenses.
NOTE: that SAS requires their customers to purchase the maintenance and support from SAS for software purchased directly from SAS. Therefore "old" software, often mainframe software, requires the customer to continue a relationship directly with SAS. That relationship is also allowed using this State Contract. SAS address is:

Facts regarding different types of services and the requirement for the use of the IT Services Contract (VMS)the completion of a Cost Benefit Analysis (CBA) and the Bargaining Unit notification.
Maintenance and support are covered as long as the services do not include professional or consulting services costing over $25,000.
However, the maintenance/support package offered by the vendor may include some services that are considered "professional".
For Example, Support may include a support help desk as well as updates, fixes, etc., therefore each agency needs to determine whether the value of their SAS maintenance/services support (verses updates, fixes) exceeds $25,000. A suggestion for determining the value of the professional service to the agency might be estimating the number of hours the agency spent (over a 12 month period) having SAS/EIS help them solve problems, install software etc. Multiplying the total hours times $100/hour (or some other reasonable dollar amount) should equal the reasonable value of the service. The Agency is required to do a CBA and conduct the Bargaining Unit notification when the value exceeds $25,000.
For Professional/Consulting Services
Agencies may use this Contract for professional or consulting services only after the agency has received the proper procurement authority. If the cost of the services is over $25,000, the following is required. Complete a CBA, conduct the Bargaining Unit notification, issue an RFS on the mandatory IT Services Contract (the VMS), obtain a waiver from the State Bureau of Procurement's IT Services Contract Manager if the RFS process does not produce a viable candidate and conduct one of the following, an RFB, RFP or an RPA to obtain a Governor's waiver.
If the cost of the services is under $25,000, the agency must do the following. Issue an RFS on the mandatory IT Services Contract (the VMS), obtain a waiver from the State Bureau of Procurement's IT Services Contract Manager if the RFS process does not produce a viable candidate and conduct the simplified bid process or write a justification for a sole source procurement.
