- 5/12/2008 Update regarding the Cost Benefit Analysis (CBA) process. While this Contract does NOT include consulting from Oracle, the Contract does include HELP DESK Technical Support. It consists of solving technical problems at the user''''''''s location. Support also includes updates, fixes, etc., therefore each agency needs to determine whether the value of their Oracle services support (verses updates) exceeds $25,000. A suggestion for determining the value of the service to the agency might be estimating the number of hours the agency spent (over a 12 month period) having Oracle help them solve problems (e.g., break-downs, install software, etc). Multipling the total hours times $100/hour (or some other reasonable dollar amount) should equal the reasonable value of the service. The Agency is required to do a CBA when the value exceeds $25,000.

Oracle''''''''s Ordering Document must also reference BOTH Contract #s.
This Contract covers the purchase of Oracle software programs, technical support and training only. Note that PeopleSoft and JD Edwards programs are NOT included in this Contract.
Consulting services are not covered by the Contract and must be obtained using the IT Services Contract when possible or by obtaining approval from DOA to bid separately.
The State is recommending agencies and municipalities consider all approved solutions when renewing, expanding or exploring a database installation.
Currently, the Division of Enterprise Technology has approved Oracle, IBM''''''''s DB2 and Microsoft''''''''s SQL Server as meeting the State''''''''s standards for enterprise database technology.
Before ordering or signing any Oracle Ordering Documents, the State and Oracle strongly suggest that you read the entire attached Contract and the connected links. The Oracle Ordering Document and its terms and conditions is also part of the Contract. (See Section P. 15 Order of Precedence). If there are conflicts between the Contract and the Ordering Document, the Contract takes precedence. The Ordering Document could have transaction specific terms, e.g., where and when to ship. The State''''''''s Purchase Order and its terms and conditions do not negate any of the Ordering Documents terms and conditions or the Contract Agreement.
Note that price list is firm for the entire Contract period of one year.
Be sure that the State''''''''s Contract Number is on the Ordering Document and the Purchase Order.
Agencies should consider consolidating their orders to obtain better discounts whenever possible. Details are worked out with the Oracle Account Manager--Sheri Rossi.
The Technical Support cost is 22% of the Program license therefore be sure to obtain the best possible price for the Program.
The 1st and 2nd year Technical Support renewal prices cannot be more than 2% over the previous year. (See Section I- Technical Support in the attached Contract.)
If Agencies have contractors who need to access Oracle manuals or Oracle programs, they must not be contractors who compete with Oracle. Agencies must have the contractors sign a confidentiality agreement as well as indemnify the State of Wisconsin.
The terms and conditions on Exhibit E (Technical Support Policies) will be firm for this Contract for one year even if the terms and conditions change on Oracle''''''''s web site. Ignore Oracle''''''''s Technical Support Policy document on the WEB.
We will pay Oracle for Technical Support quarterly and in arrears. Invoices should clearly identify the period covered.
No shrink wrap, click-wrap, etc. conditions apply to the State. (See Section M Entire Agreement in the attached Contract).
We do not have to identify the individuals when buying named user licenses.
Special notes about the Contract Document:
References and links to the following website are located several places in the Contract document. http://www.oracle.com/contracts. This is a “Home Page” for lack of a better definition, to other links that might be appropriate for the Contract.
This Oracle “Home Page” states the following incorrect information for our Contract. Ignore the following sentence on Oracle’s web site. “Oracle has a consistent contract model for all programs and services globally. The standard contracts often refer to other sites or policies that may be relevant to a specific order or provide more information on policy, links to the specified policies are available here.”
Some of the policies in our attached Exhibit E (Technical Support) are incorrect such as the following:
Exhibit E states that fees for technical support are due annually in advance. This information is incorrect.
Section I “Tech Support” in the Wisconsin Contract states the following:
“Fees for technical support are invoiced quarterly in arrears and are due and payable in accordance with Section K.”
Any reference to PeopleSoft in Exhibit E does not apply to this Contract.
Exhibit E states that users must go to the Metalink to learn about programs that will be desupported. This is not a requirement in our Contract.
Section I, “Tech Support” in the Contract states the following:
“Oracle reserves the right to desupport its Programs or particular versions of its Programs. The State shall be notified by mail or email twelve (12) months in advance when Oracle determines that a Program is to be desupported.”
